China, Countdown to Introducing Punitive Damages for Copyright Infringement

(Seoul=NSP News Agency) soon ki Lee Journalist = China has launched a legislative process to revise the Copyright Act. The Copyright Act(revised draft), which had been discussed for about 10 years, was submitted to the first meeting of the 13th National People's Congress (NPC) Standing Committee on April 26, 2020.


The main contents of the Copyright Act (revised draft) are ▲Introducing a punitive damages system that can claim compensation up to 5 times the actual damage ▲Reinforcing copyright protection in the online space ▲Reinforcing the management and supervision of intensive management groups ▲Reflecting international copyright-related treaties.

It is expected that the protection of intellectual property rights of Korean companies that have advanced into China will be further strengthened by introducing the ‘punitive damages system for intentional infringement’ among the major changes in the copyright law.

The punitive damages system for intellectual property infringement in China has already been introduced in the Chinese Trademark Law and the Anti-Unfair Competition Law, and is a key issue in the revision of the patent law currently in progress.

The Chinese government shows a strong response to the infringement of intellectual property rights and a move to equally protect internal and external citizens in court decisions.
